  1. Too bad the guy that shot the video (James Kachel), has a complete disregard for the law! He might have filed with the FAA for the drone and created a company, but he DOES NOT have an FAA exemption that alows flying over people and emergency crews, which includes fires! Just another disregard for laws that puts people and equipment at risk because he has no idea what he’s doing!

  2. I am from the FAA Rockford division and we do not see any problem with this flight.
    The operator takes off a safe distance away, does not fly over people or emergency crews, and does not hinder the operation in any way. .
    There should be a “Law” about folks like you filing false reports wasting the time of officials like myself.
    Lastly, the 333 exemption was ONLY for commercial flights, and is no longer applicable, (and that is why you no longer see it on our website). It has been replaced with Part 107.

    Please educate yourself before wasting our time with unsubstantiated complaints.

    • First of all, I never stated or claimed to file a report, so I have no idea where you got that from?
      Second, why would Rockford have anything to say about a UAS since they handle air worthiness and airport safety! UAS enforcement would be out of the Des Plaines office which I have been in contact with to ask questions for commercial certification.
      Third, if you are flying commercially (which Elevated Perceptions is) and based on the date the filming was done, he would need the 333 exemption because part 107 doesn’t go into effect until 8/29/2016. Also, regardless of exemption, he shouldn’t fly within 5 miles of an airport without notifying them first! 3ck is exactly 3.3 miles from the house fire, but I guess the FAA could forget about a small airport like that? He’s also supposed to notify 3CK of his flying ahead of time, which he didn’t (verified)! https://www.faa.gov/uas/getting_started/fly_for_work_business/
      Now if he is claiming to fly and film for personal use (which can’t be since all his films are for sale, but I’ll humor it), the airport distance is still an issue here! Also it states “never fly near emergency response efforts such as fires” which he did. Maybe the distance was far enough away, but since my last post, I have learned from local authorities and first responders that he wasn’t, which created a distraction in an emergency situation. Personal use also states “Never fly near other aircraft, especially near airport” and there was an aircraft very close at the time of the video (which I verified). This UAS was northeast of the fire and a plane leaving 3ck heading southwest and was the same distance to the fire, but the plane was 700 ‘higher. Still qualifies as too close to other aircraft!       I wanted to make sure I didn’t misunderstand something along the way so I figured I would call Rockford this last Friday and ask some questions about the previous post and just what I thought, had no idea what I was talking about and they said to try one of these regional offices https://www.faa.gov/about/office_org/field_offices/fsdo/?state=IL
      So either the FAA needs to educate themselves on the new laws or (more likely the case) the post was made by the pilot who has a very long history of doing things like this.
      Funny how privacy setting changed. If I did nothing wrong, I wouldn’t hide it!
